Activision Wins Call Of Duty Lawsuit Related To Using Humvees In The Franchise

Gaming giant Activision has emerged victorious in a lawsuit brought against it by the makers of Humvee vehicles who claimed the publisher was infringing on their trademark.

A New York judge has dismissed the lawsuit from General Motors, bringing an end to this case. The lawsuit dates back to 2017 when GM sued Activision for trademark infringement, unfair competition, and false advertising, among other things. Activision responded (via The Verge) by saying it had the protection of the First Amendment to use the image of real-world military equipment in its franchise.

Activision’s lawyers said GM was acting in bad faith by trying to use a trademark to control the creative use of a US military vehicle paid for by American taxpayers and used in every war and conflict for decades.

Judge George Daniels said the Call of Duty franchise passed the “Rogers test,” a landmark ruling from the 1980s which relates to trademarked names in creative uses. According to Daniels, Activision’s use of Humvees in Call of Duty games “have artistic relevance.”

“Featuring actual vehicles used by military operations around the world in video games about simulated modern warfare surely evokes a sense of realism and lifelikeness to the player who assumes control of a military solider and fights against a computer-controller or human-controller opponent across a variety of computer-generated battlefields,” Daniels said.

The judge went on: “Upon reviewing a copy of the Call of Duty game, the court explained that the uses of the plaintiff’s name and logo easily met the artistic relevance requirement under Rogers because they have players a sense of particularized reality of being part of an actual elite special forces operation and served as a means to increase specific realism of the game.”

“Any reasonable juror would conclude that the presence of Humvees in Call of Duty games possesses an artistic value that is at least above zero.

The judge also ruled that Activision’s use of Humvees in Call of Duty games is not “explicitly misleading.” The Call of Duty games never position Activision as the owner or creator of the vehicles.

Apex Legends Season 5 Has A “Pleasant Surprise” For Titanfall Fans

According to Respawn, fans of Titanfall and Titanfall 2 may be excited to see what Respawn has in store for Apex Legends at the start of Season 5. Season 5 is scheduled to begin in late May or early June, as Season 4: Assimilation is halfway done, having gone through its ranked series split.

In an interview in Game Informer Issue 324, Apex Legends general manager Dusty Welch and game director Chad Grenier spoke about the future of Respawn’s battle royale game, with one of them saying, “We’re always bringing in stuff from the Titanfall universe. We built an awesome world in Titanfall 1 and 2 and want to make sure we’re bringing that forward. I will say this: There could potentially be a pleasant surprise for Titanfall fans in Season 5.”

Neither Welch nor Grenier provided further details beyond that, though Season 5’s tie to Titanfall could be hinted at with the arrival of Bloodhound’s town takeover. The arrival of the technological tracker’s town takeover was teased with a prowler, a vicious wolf-like creature native to the planet Leviathan (the setting of Titanfall 2’s incredible Effect and Cause level). Perhaps, just as Apex Legends left Kings Canyon after two seasons, the battle royale is getting another brand-new map after two seasons on World’s Edge–one that will be located on Leviathan.

Elsewhere in the interview, Welch and Grenier also talk about which of Apex Legends’ playable characters are most popular. Grenier says that the rankings change from season to season, though Pathfinder and Wraith are almost always among the top picks and that Wattson is popular on the competitive side. “Caustic has been [popular] from a pro player or tournament standpoint,” Welch added. “He’s been an interesting player favorite, especially when they get into the final areas.”

Lord Of The Rings Actors Pay Tribute To Dialect Coach After His Passing

Movie dialect coach Andrew Jack, who worked on The Lord of the Rings and Star Wars franchises among many others over a career that spanned decades, has passed away due to complications related to COVID-19. He was 76.

In response to his passing, tributes have poured in from across Hollywood, including the stars of the Lord of the Rings films. For Peter Jackson’s Lord of the Rings movies specifically, Jack was the senior supervising dialect coach, according to The One Ring. He helped the actors with their accents for Middle-earth.

Elijah Wood, who played Frodo in the series, said he was heartbroken to learn of Jack’s passing. “He was a kind and lovely human being,” Wood said.

Billy Boyd, who played Pippin in the series, said Jack was a “beautiful soul,” adding that he had “so many wonderful memories with this amazing man.” Kiran Shah, who was the stand-in for Frodo in the Lord of the Rings series, says Jack was a good friend. “Will miss him,” he said.

Sean Astin, who played Sam in the trilogy, released a poem about Jack in which he called the man funny, brilliant, and gentle. “We loved Andrew Jack,” Astin said.

Karl Urban, who played Eomer, said he was “shocked and deeply saddened” to learn about Jack’s passing. Urban first met Jack on Lord of the Rings, and he was recently working with him again for season two of Amazon’s The Boys. “Andrew was such a gentle giant and a man who possessed such great generosity of spirit,” Urban said. “He was extraordinarily talented, professional, and an absolute joy to work with. My heart thoughts and prayers go out to his family.”

In addition to Lord of the Rings, Jack contributed to numerous other projects, including Solo: A Star Wars Story. Original co-director Christopher Miller said Jack was a “kind and thoughtful man.” Jack taught Han Solo actor Alden Ehrenreich to speak Shyriiwook, the language of Wookies. “I’ll always remember listening to them gargle-roar at each other back and forth. RIP,” Miller said.

Jack’s contributions in Hollywood are extensive and date back decades. Recently, he helped Chris Hemsworth with his Thor accent for Avengers: Endgame and Infinity War. Jack also coached John Boyega for his American accent in The Force Awakens and The Last Jedi. On top of that, Jack helped Viggo Mortensen with his Russian accent for Eastern Promises, a role that earned Mortensen the first of his three Academy Award nominations. In addition to his career as a voice coach, Jack was an actor. He played General Ematt in The Last Jedi and he voiced Moloch in Solo.

Animal Crossing: New Horizons Player Turns Island Into Zelda: Link To The Past Homage

Thanks to the addition of terraforming and infrastructure options available in the newest Animal Crossing game, Animal Crossing: New Horizons, players are free to create almost any island home they like. One player, reddit user VaynMaanen, has created an impressive homage to Zelda: Link to the Past, recreating the original SNES map with high levels of detail and dedication.

The recreation goes beyond just the map, with VaynMaanen going to the effort to recreate the landmarks and villagers as best you can with the tools in Animal Crossing: New Horizons. Paths, flowers, trees, ponds, and even an ocarina all work in tandem to recreate the classic Zelda feel in a 3D space on the Switch. Seeing an island like this makes you wonder how a Zelda: Link to the Past remake would look on the Switch.

Of course putting in enemies, dungeons and some of the more unique structures will prove to be difficult, but the whole point of Animal Crossing is to be creative, it will be interesting to see what kind of solutions people come up with.

The creator stated that it took him four days to complete, this is of course after playing the game through to unlock terraforming. VaynMaanen claims to not be finished with his recreation, but is now keen to actually focus and play Animal Crossing properly now that the majority of the work is done.

More Xbox Series X Game Reveals Are Coming Soon, According To Xbox Boss

Xbox Series X is due holiday 2020, but up until now we haven’t seen many game reveals for the console beyond Halo Infinite and Hellblade II. But in an interview for IGN’s podcast Unlocked, Xbox boss Phil Spencer says that’s going to change soon, and future reveals will have a much greater focus on games.

When asked if there was anything left to say about the system itself, or whether it was “all games from here on out,” Spencer said that while there are still things to reveal about the system and services provided by Xbox Series X, what they’ve announced so far has been done to “make room for games” in their further reveals.

“We know games are what people play,” Spencer says. “You don’t play variable rate shading, you don’t play ray tracing, you play the games that use those technologies.” Showing off these technologies has paved the way for them to show off how their games will use them. “This is one of the reasons we had Hellblade when we did the unveil at the Game Awards–I thought showing up at the Game Awards without a game would be a little tone-deaf,” he continued.

Spencer promises that Microsoft is “definitely going to be leaning into the games talk now” in the lead-up to release. “A vast majority of what we’re going to be talking about going forward, and frankly our third parties want to talk about as well, is the great games,” he says.

Elsewhere in the interview, Phil Spencer commented on the impact of COVID-19 on the system and Halo Infinite, reiterating that the system will not be delayed. Spencer also says that Xbox has a “winning plan” for how it will compete with the PlayStation 5.

The Division 2 Urban Jungle Apparel Event Is Now Live On PS4, Xbox One, and PC

The Urban Jungle Apparel Event is now live in The Division 2. Running until April 20, the latest event gives you a chance to earn new apparel for your agents via time-limited Apparel Caches.

There are 35 new apparel items included as part of the Urban Jungle event. Earning cache keys is done by leveling up your SHD levels (one key is awarded for every four levels), or by purchasing them outright using Premium Credits. Anyone who logs in will receive one key to get started, and you can gift keys to other players as well.

The event contains a collection of four full cosmetic outfits: Reconnaissance, Hazard, Gorilla, and Chrome. It also includes additional clothing items, four weapon skins, and one mask. If you manage to collect every item from the event, you’ll be awarded the unique Purifier Face Mask. Fortunately, Event Caches don’t contain duplicates, so there’s no RNG preventing you from getting your hands on everything.

This isn’t the only new content for The Division 2 this week either. Ubisoft recently unleashed another Rogue Agent for you to hunt down if you own Season One of the recent Warlords of New York expansion. A new update also rolled out in the past few days, introducing some balance changes to health and damage, along with a host of other fixes and improvements.

The Division 2 was awarded a score of 9/10 in GameSpot’s review. Edmond Tran said, “The range of enemy types continues to keep combat encounters challenging, the equipment I earn and pick up continues to feel different, valuable, and asks me to consider new ways of play. The ravaged environments continue to intrigue, and sometimes they’re so stunning I find myself needing to take screenshots before I move on. It might not have much to say, but The Division 2 is a perpetual cycle of tension, relief, and reward that’s difficult to stay away from.”

Elder Scrolls Online Patch Notes Prepare For Greymoor

The Elder Scrolls Online is preparing to close the book on its Skyrim story as it transitions into the Greymoor season. The new content isn’t live yet, but the prologue chapter is now available alongside a patch on PC, PS4, and Xbox One.

The patch notes across all three platforms make some of the same changes, especially across the two console platforms. On PC the patch has fixes for some abilities and a game crash, but the notes say the developers are still investigating ability desyncs and lag. On PS4 and Xbox One, there are input delay and desync fixes, and a fix to the Coldharbour questline.

A free prologue chapter for Greymoore is now available in advance of the story’s launch. Paired with a limited time free-play period, you can dip a toe in the new content. Parent company Bethesda also recently announced that it is canceling the digital showcase that it had planned to give in absence of its E3 appearance.

The Elder Scrolls Online v5.3.8 has some fixes for the Undo and Burning Embers abilities, the Stone Keeper fight in Frostvault, a game crash, and a couple other smaller bug fixes. Investigations are still ongoing for the ability desyncs and lag, as mentioned in last week’s performance update. The size of this patch is approximately 61MB.

Animal Crossing: New Horizons Spirits Are Coming To Smash Bros. Ultimate

Super Smash Bros. Ultimate‘s next Spirit Board event is themed around Animal Crossing, Nintendo has announced. The event kicks off at 11 PM PT on April 2 and adds four new Spirits from the recently released Animal Crossing: New Horizons to the game.

Spirits based on the major new characters introduced in New Horizons–Flick, CJ, Daisy Mae, and Orville & Wilbur–will appear on the Spirit Board at certain times during the event. On top of that, all of Smash Bros. Ultimate’s previous Animal Crossing Spirits will also be featured periodically throughout the event, giving you a much better chance of encountering them.

The Animal Crossing Spirit Board event runs until 11 PM PT on April 7. You can learn more about the event on Nintendo’s website.

In other Smash Bros. news, Nintendo confirmed during its recent Direct Mini presentation that the game’s next DLC character–and the first to be added as part of the Fighters Pass Vol. 2–will be from Arms. The character is slated to be revealed and released this June, but Nintendo noted at the start of the Direct Mini that release dates could be affected by the ongoing COVID-19 pandemic.

As for Animal Crossing: New Horizons, the game’s first seasonal event, Bunny Day, is underway now until April 12. During that time, you’ll be able to find different kinds of eggs around your island and use those to craft special Bunny Day items. This Steam Game Is The Netflix Party Of Board Games, And It’s Perfect For Right Now

As the US and other countries mobilize to prevent the spread of the coronavirus, more and more people are finding themselves stuck at home these days, effectively ending normal social interactions with friends and loved ones unless they live with you. Because of this, online games and platforms like Netflix Party have become crucial links to friends and family, and one 2015 PC game is even helping people have virtual board game nights with friends they can’t meet with in person.

Tabletop Simulator has been around for years, but it feels even more needed right now. The indie game from developer Berserk Games allows you to play digital versions of board games in a player-driven physics sandbox, with classics like chess, poker, and dominoes included in the base version. You can also create your own digital board games with Tabletop Simulator, which lets you import custom assets, automate games with scripting, and more. And players have done just that, with thousands of fan-created board games and card games available in the Steam Tabletop Simulator workshop that you can play for free.

Berserk Games has also partnered with some board game publishers to create official DLC for Tabletop Simulator, and there are currently 41 games available as DLC, including some of our all-time favorites like Blood Rage, Scythe, and Wingspan.

I gave Tabletop Simulator a try for the first time recently and was surprised by how well it replicated the feeling of playing a board game. Naturally, some fan-made creations will run better than others, and if you’re looking for a more niche game, it may not be as polished. My group tried out a few different games, and while connectivity issues occasionally booted one of us out of the game, we had a great time playing some of our favorite games in this medium. The always-popular Catan was easy to pick up and start playing, and we ran an entire game of Root, a complex asymmetrical war game, with hardly any issues. It felt almost like we were all sitting around the same table as usual, and it was honestly the happiest I’ve felt since quarantine began.

If you check out the recent Steam reviews for Tabletop Simulator, it’s pretty clear I’m not the only one turning to this game as a source of entertainment and socializing during the times of coronavirus. “In these times of social distancing, Tabletop Simulator has saved our weekly gaming group,” wrote one recent reviewer. “I’m thankful to be able to have board game nights with my friends at a time like this,” wrote another.

While the game is available directly on Steam, many stores that would offer discounted Steam codes for the game have recently run out of stock, including Fanatical, Humble Bundle, and Green Man Gaming. However, you can still snag a small discount on the four-pack, which gets you four Tabletop Simulator Steam codes to share with friends, at Green Man Gaming. Normally sold for $60, the four-pack is currently on sale for $54, a price you could then split with whomever you’re playing with.

Tabletop Simulator offers a pretty good tutorial the first time you boot up the game, but I’d also recommend starting with a game you’re familiar with so you can get accustomed to the controls without fretting over the rules.
